Terms and Conditions for Pawplay LLC
This Agreement sets forth the terms and conditions between Pawplay LLC. (“Pawplay,” “we,” “us,” or “our”), located at 473 Caldwell Boulevard, Nampa, ID 83651, and each customer (the “Owner,” “you,” or “your”) who uses our dog daycare and boarding services. By enrolling your dog(s) at Pawplay, you agree to these Terms and Conditions in full and warrant that you have the authority to enter this Agreement.
1. Services Provided
1.1 Daycare Services: Pawplay offers dog daycare services, including but not limited to supervised play, exercise, socialization, feeding, and rest periods.
1.2 Boarding Services: Pawplay provides overnight boarding services, where dogs will be housed, fed, and monitored by staff.
1.3 Additional Services: At our discretion, Pawplay may offer additional services, such as grooming or specialized care, which will be outlined in a separate agreement, if applicable.
2. Owner Representations and Warranties
By enrolling your dog at Pawplay, you represent and warrant that:
2.1 Dog Health and Safety: Your dog is in good health, free from contagious diseases, up-to-date on all vaccinations (including rabies, distemper, and bordetella).
2.2 Dog Behavior: Your dog does not have any history of aggressive behavior towards people or other animals. You agree to notify Pawplay of any change in your dog’s temperament that could affect its behavior with other dogs or people.
2.3 Legal Ownership: You are the lawful owner of the dog or have the right to authorize services on behalf of the dog’s lawful owner.
2.4 Medical Authorization: You authorize Pawplay to obtain medical treatment for your dog in the event of injury or illness, and you agree to reimburse Pawplay for any associated costs incurred.
3. Payment and Fees
3.1 Rates: All rates are available upon request and are subject to change at the discretion of Pawplay. Rates include standard daycare and boarding services; additional fees may apply for special services or holiday rates.
3.2 Payment Terms: Full payment is required at the time of service unless otherwise specified in writing. Pawplay accepts payment by credit card, debit card, or other approved payment methods.
3.3 Late Payment and Fees: Any payment not made within 7 days of the due date may be subject to a late fee of up to $25, plus interest at the maximum rate permitted by law.
3.4 Cancellations: Cancellations for boarding services must be made at least 48 hours in advance. Pawplay reserves the right to charge a cancellation fee of up to 50% of the service rate for cancellations made without proper notice.
4. Risk Assumption and Liability Waiver
4.1 Owner Assumption of Risk: The Owner acknowledges that certain risks are associated with dog daycare and boarding, including but not limited to injuries or illnesses resulting from dog interactions. By enrolling in our services, you assume all such risks and release Pawplay from liability, except in cases of gross negligence or intentional misconduct.
4.2 Injury or Illness: Should your dog become ill or injured while under Pawplay’s care, Pawplay will make reasonable efforts to contact you. If immediate medical attention is needed and you cannot be reached, you authorize Pawplay to secure veterinary care at your expense.
4.3 Personal Property: Pawplay is not responsible for loss or damage to any personal items left with your dog, including leashes, collars, bedding, or toys.
4.4 Responsibility for Damages: The Owner agrees to be solely responsible for any injuries, damages, or losses caused by their dog while in the care of Pawplay, including but not limited to damage to Pawplay’s property, injuries to staff, or harm to other animals.
4.5 Indemnification: The Owner agrees to indemnify and hold Pawplay harmless from any claims, costs, or expenses (including attorney’s fees) arising from their dog’s actions, behavior, or negligence during their stay or participation in daycare or boarding services.
5. Aggressive Behavior and Removal Policy
5.1 Aggression: Pawplay reserves the right to refuse or terminate services if your dog exhibits aggressive or dangerous behavior. Such behavior may include, but is not limited to, unprovoked biting, excessive barking, growling, or signs of distress.
5.2 Removal: If Pawplay determines that your dog cannot safely participate in our services, we will notify you to pick up your dog immediately. You will be responsible for any additional fees incurred due to early removal.
5.3 Aggression Disclosure: The Owner hereby certifies that their dog(s) has/have not harmed or shown aggressive or threatening behavior towards any person or any other dog.
5.4 Responsibility for Damages: The Owner agrees to be solely responsible for any injuries, damages, or losses caused by their dog while in the care of Pawplay, including but not limited to damage to Pawplay’s property, injuries to staff, or harm to other animals.
6. Vaccination and Health Requirements
6.1 Vaccinations: Your dog must be up-to-date on vaccinations, including but not limited to rabies, distemper, and bordetella, as well as other vaccinations required by local regulations.
6.2 Parasites and Flea Control: All dogs must be free of parasites, fleas, and ticks. If a dog is found to have parasites, fleas, or ticks, Pawplay reserves the right to charge for treatment or to decline services until the issue is resolved.
6.3 Health Conditions: Owners must disclose any health conditions, allergies, or special dietary needs of their dog prior to using our services. Pawplay reserves the right to decline services if we are unable to meet your dog’s specific health needs.
6.4 Spayed/Neutered: All dogs 7 months or older must be spayed or neutered to be enrolled in daycare.
7. Emergency Procedures
7.1 Emergency Contacts: The Owner may provide two emergency contacts who can be reached during the time your dog is in our care.
7.2 Medical Emergencies: In the event of a medical emergency, Pawplay will make reasonable efforts to contact the Owner or the emergency contacts. If we are unable to reach you, we will seek veterinary care at your expense.
7.3 Natural Disasters or Other Emergencies: In the case of natural disasters or emergencies beyond Pawplay’s control, such as fire, flood, or severe weather, Pawplay will take reasonable measures to protect your dog. However, we shall not be held liable for any injuries or damages resulting from such events.
8. Owner’s Indemnification Obligations
You agree to indemnify, defend, and hold Pawplay, its officers, employees, and agents harmless from and against all liabilities, losses, damages, costs, and expenses (including reasonable attorney’s fees) resulting from any claims related to your dog’s behavior, health, or any breach of these Terms and Conditions.
9. Miscellaneous
9.1 Governing Law: This Agreement is governed by the laws of the State of Idaho.
9.2 Entire Agreement: These Terms and Conditions represent the entire agreement between Pawplay and the Owner concerning the services provided and supersede all prior agreements or representations.
9.3 Severability: If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
9.4 Modifications: Pawplay reserves the right to modify these Terms and Conditions at any time. Such modifications will be communicated to you by posting on our website or by other reasonable means.
9.5 Waiver: The failure of either party to enforce any right or provision of this Agreement shall not constitute a waiver of that right or provision.
10. Media Release and Usage
10.1 Consent to Use Images: By enrolling your dog at Pawplay, you grant us permission to take photographs, videos, or other visual media of your dog while in our care. You agree that Pawplay may use, reproduce, and publish these images on our social media platforms, website, and in other marketing and promotional materials without additional consent or compensation.
10.2 Ownership and Rights: All photographs and media taken by Pawplay are the sole property of Pawplay. You waive any rights of ownership or claims to royalties or other compensation for the use of such media.
10.3 Opt-Out: If you prefer that we do not use images of your dog for marketing purposes, you must notify us in writing prior to your dog’s participation in our services.
